Mr. DeFelice has handled hundreds of appeals in both Criminal and Immigration matters as well as appeals in Civil cases such as divorce, child support, litigated real estate matters, and Family Court matters. In the Criminal area he has been successful in overturning convictions for murder and other serious offenses. In the area of Immigration Law he has also had orders of removal/deportation reversed by the Board of Immigration Appeals and has been successful in convincing the Appellate Court that a finding by an Immigration Judge that a crime was considered an “aggravated felony” was incorrect. Thus obtaining a reversal of an order which would otherwise had led to deportation.He has represented clients in both the US District Court and Circuit Court of Appeals on Immigration matters and obtained a reversal on matters involving the Violence Against Women Act and other matters. He has also represented clients in other types of Civil Cases including a matter involving the Freedom of Information Law which led to a reversal of a lower court ruling by the State Court of Appeals and in the case of Josan v Josan which was one of the earliest decisons on equitable distribution in New York.
